    H-1B to EB-5: Concurrent Filing Timeline

    Source of Funds Gathering

    Document and trace the lawful source of your investment funds. This is the most critical preparation phase.

    • Gather employment records, salary slips, and tax returns
    • Document any gifts from family with proper gift letters
    • Trace funds through bank statements (typically 5+ years)
    • Work with immigration attorney on documentation strategy

    I-526E + I-485 Concurrent Filing

    File both petitions simultaneously to maximize processing efficiency and unlock interim benefits.

    • Complete EB-5 project subscription documents
    • Transfer investment funds to escrow
    • File I-526E (EB-5 immigrant petition)
    • Concurrently file I-485 (adjustment of status) if eligible

    Work Permit (EAD) Arrival

    Receive your Employment Authorization Document, freeing you from H-1B employer dependency.

    • EAD typically arrives 7-9 months after I-485 filing
