    Year 1

    University Admission & F-1 Entry

    Secure admission to a SEVP-certified school and obtain your F-1 student visa. This is the foundation of your U.S. journey.

    • Receive I-20 from your university
    • Pay SEVIS fee and schedule visa interview
    • Enter the U.S. up to 30 days before program start

    Final Semester

    Graduation & OPT Application

    Apply for Optional Practical Training (OPT) to gain work authorization after completing your degree.

    • Apply for OPT 90 days before graduation
    • Receive EAD card (work permit)
    • STEM students may extend OPT for additional 24 months

    90 Days

    The Critical Window (90-Day Unemployment Rule)

    You must find employment within 90 days of OPT approval or risk losing status. This is where EB-5 planning becomes crucial.

    • Maximum 90 days of unemployment allowed during OPT
    • Begin EB-5 due diligence during this period
    • Consider concurrent filing strategy to preserve options

    I-526E Filing (Freezing Status)

    File your I-526E petition to lock in current EB-5 requirements and begin the path to permanent residency.

    • Complete source of funds documentation
    • Select and invest in qualified EB-5 project
    • File I-526E with USCIS (may file concurrently with I-485)

    Months 7-24+

    EAD Arrival vs. Green Card Approval

    Receive work authorization through your pending I-485, then await final green card approval.

    • EAD typically arrives 7-9 months after I-485 filing
    • Work freely for any employer with EAD
    • Green card approval typically 18-24+ months after filing
